Happy Monday! Sam and Emma speak with Dave Weigel, politics writer at Semafor, author of the "Americana" newsletter just one day out from the 2024 election. It's Hump Day! Sam speaks with Molly Redden, reporter covering national politics at ProPublica, and Andy Kroll, reporter covering voting, elections, & democracy at ProPublica, to discuss their piece of reporting entitled “Put Them in Trauma”: Inside a Key MAGA Leader’s Plans for a New Trump Agenda. First, Sam runs through updates on the final six days to the US election, early voting numbers, RFK’s ballot problems, Trump’s threat to Police over mass deportations, the US economy, Israel’s en masse slaughter of civilians in Gaza and Lebanon, and Elon Musk v. the NLRB, before briefly touching on the role of Kamala Harris’ identity in voters’ support of/aversion to her. Molly Redden and Andy Kroll then join, diving right into who Russell Vought is in the context of Trump’s first administration (Director of the Office of Management and Budget), current campaign (policy director of the RNC platform committee), and the SUPPOSEDLY unrelated Project 2025 (co-author), before touching on the role he played in the evolution of the Trump team’s knowledge of the administrative state, and – more importantly – how to dismantle it. It's News Day Tuesday! Sam and Emma speak with writer and editor Gareth Gore about his new book Opus: The Cult of Dark Money, Human Trafficking, and Right-Wing Conspiracy inside the Catholic Church. First, Sam and Emma run through updates on Trump’s visit to Allentown in the wake of his fascist rally in New York, the Harris Campaign, polling, Florida’s abortion amendment, attacks on ballot boxes in Washington, Nevada’s election rules, Steve Bannon’s release from prison, fallout from Bezos’ rule over the Washington Post, and Israel’s banning of UNRWA, before expanding on the overwhelming backlash to Tony Hinchcliffe’s set at Trump’s fascist rally in NYC, and a potential connection to one Joe Rogan. Gareth Gore then joins, diving right into the story of his research into the collapse of a Spanish bank that led him to uncover the outrageous and extensive financial connections between Opus Dei, said bank, and myriad “hospitality” schools across the globe that routinely trafficked women, before stepping back to unpack what Opus Dei is and its process of radicalization under Spanish Priest (and founder) Josemaría Escrivá in early 20th Century Spain to become the reactionary, militant, elite-connected, and Papal-doubting organization that we see today. Craig Gent then joins, diving right into the mass proliferation of AI and algorithmic practices, not as a replacement for physical or technical labor, but as a replacement for management, exploring how the traditional role of human managers of overseeing a workplace has been replaced with automated systems that employ everything from gamification to surveillance and punishment to keep production in line with neoliberal aims of endless growth. Expanding on this, Gent walks through how these systems serve to further atomize and isolate an already alienated workforce, creating a supposedly infallible system that dictates their every move and completely obfuscates the power dynamics at play, resulting in a working environment with little to no space for agency, dignity, or solidarity, before briefly touching on how workers are desperately seeking for any way to leverage agency in these workspaces. Craig also highlights the pressing need for unions to open up their awareness to the threat of this technology, not as a tool that COULD be used to exploit them, but as ones that were explicitly created TO exploit them, working to suppress and pull back the exploitative nature of these systems rather than attempting to “share” in the benefit of this exploitation. Emma also tackles Bill Ackman’s defense of Trump’s appreciation of Adolf Hitler.

First, Sam runs through updates on the last two weeks heading into US elections, Trump’s fascism, Israel’s indiscriminate offensives on Gaza and Lebanon, election interference, Rudy Giuliani’s legal (and financial) woes, Georgia’s election regulations, the House GOP’s leadership jocky, and Trump’s upcoming Rogan appearance, before diving a little deeper into the moral, humanitarian, and all-around political failure that has been the Biden Administration’s full-scale backing of Israeli genocide. Mark Joseph Stern then joins as he and Sam first unpack the suspicious lack of a major (both in quantity and quality) court load for the final Supreme Court term heading into the 2024 elections, exploring the conservative-majority Court’s active attempt to fade into the background rather than risk making controversial decisions (which they surely would) should they hurt Trump’s chances. Stern then looks to a few major cases that SCOTUS has shunted to after November, first tackling Garland v. Happy Monday! Sam speaks with Grace Blakeley, English economics & politics commentator, staff writer at Tribune, to discuss her recent book Vulture Capitalism: Corporate Crimes, Backdoor Bailouts, and the Death of Freedom.
First, Sam runs through updates on the final 14 days before the US presidential election, Israel’s ongoing assault on Palestine and potential pivot to Iran, environmental disaster in Cuba, Elon Musk’s failures and fraud in his work alongside the Trump campaign, National Association of Letter Carriers’ labor news, Tesla’s regulatory problems, and the US economy, before diving a little deeper into the insanity of Elon Musk launching contrasting ad campaigns in Michigan attempting to stoke anti-Semitic and Islamophobic fears in Muslim and Jewish communities. Grace Blakeley then joins, first working to unpack the commonly accepted dichotomy between capitalism and a centrally-planned (socialist) economy, with the dystopia of socialism juxtaposed by liberalism’s vision of free-market democracy, before wading into the problems and inaccuracies of this binary, namely the fact that liberalism’s defining qualities (free-markets and democracy) don’t apply to the existing capitalist societies of today (particularly the largest imperial powers like the US and UK), where wealth and political power are becoming increasingly concentrated in the hands of fewer and fewer elites, translating into what is essentially centrally-planned oligarchy. Blakeley steps back to walk through the evolution of capitalism to this point, tackling neoliberals’ work to publically redefine a libertarian “free market” as a return to natural systems, while elites privately saw it as an explicit vision to protect corporate power amid rising social movements, establishing clear economic norms against anything that could threaten privatization, the free movement of capital, and low tax rates, while creating international institutions (backed by the West) to dole out punishment for any revolutionary states that sought to challenge them abroad, before touching on the contrasting work of a Keynesian vision – backed by the working class – that pushed the idea of a protective state and well-regulated markets, and exploring the major success this ideology had in bolstering the US labor movement of the mid-20th Century. Next, Grace walks Sam through the eventual success of neoliberal theory with the regimes of Pinochet, Thatcher, and Reagan in the late 1970s and early ’80s, and their overwhelming work to crush and fragment the working class and social power that had bolstered the social and economic progress of the century to that point, setting the stage for the solidification of the oligarchies we see today. After briefly touching on the value of a return to a more Keynesian vision for economies, and the central importance of revitalizing working-class power, Berkeley wraps up the interview by exploring a few other visions for strong, democratic, and worker-led economies.

First, Emma runs through updates on Harris’ recent sit-down on Fox, Lina Khan’s role at the FTC under Biden, polling, Israel’s ongoing offensives and genocide in Gaza, US aid to Israel, Biden’s EPA, Georgia’s election shenanigans, Jimmy Carter’s age 100 ballot, DeSantis’ war on Florida’s abortion ballot measure, and a landmark settlement over the LA Catholic Church’s systemic sexual abuse, before diving a little deeper into assessments of Harris’ antagonistic interview on Fox. Hamilton Nolan then joins, diving right into the tight-knit and interdependent relationship between social movements and the institutions that cement the progress these movements seek, unpacking the central role labor unions have played as a ground zero for channeling the energy of social unrest into concrete political progress. After expanding on the disintegration of the state of labor in the US over the last 70 years, with even Biden – perhaps the most pro-union president over that time – overseeing a one-point drop in union rates, and the factors that drove that drop (namely staunch anti-union, anti-organizing, and pro-corporation legislation), Nolan steps back to explore how the environment that this dearth of union power has created makes it exceedingly difficult to push back against it, creating a completely asymmetrical battle between workers and corporations, and why the recent renaissance of labor consciousness – bolstered by folks like Sarah Nelson, Shawn Fian, and Felix Allen – must be capitalized on not just through legislation, by but widening and organizing the millions of Americans that still exist outside of these institutions, something essential to maintaining the progress that these unions can cement. Hamilton and Emma also touch on the major role labor is playing in pushing back against the anti-democratic (and anti-labor) urges of US imperialism, wrapping up the interview by exploring the changing image of the American worker (and the American union member), and why that must be embraced. Emma also touches on Trump’s egotistic and anti-social musings about the state of immigration under Biden-Harris.

Then, Sam is joined by two attorneys from Levin Papantonio law firm, first talking with Jeff Gaddy about his ongoing mass tort case against major social media companies including Meta, Snap, Google, and ByteDance (TikTok), and their platforms’ exploitation of minors via overwhelming exposure to addictive and harmful content. Gaddy walks through these corporations’ responsibility for the design and development of their platforms, touching on the protections from liability for true third-party content that Section 230 offers and the exceptions to these protections when it comes to these corporations' production of their own (even if derivative) content and to how said design and development curates and highlights the content users engage with. After running through various other ongoing cases against these companies, Jeff and Sam unpack the developing role of legislative challenges to these practices and the importance of civil law in pushing these issues into the open, wrapping up the interview by briefly touching on the major revelations in discovery and what the “damages” of this exploitation look like. Cameron Stephenson is the next attorney to join, diving into the recent proliferation of GLP-1RA drugs, from the FDA’s approval of Ozempic as a diabetes medication in 2017, through the now sixth variation between Novo Nordisk and Eli Lilly that focuses more on medical (or even cosmetic) weight loss, and the pharmaceutical industry’s complete failure to properly warn some millions and millions of patients about serious risks and side effects associated with the drug class – namely gastroparesis. After expanding on the particular role off-label marketing of cosmetic uses played in contributing to the pervasion of GLP-1RAs – despite the relatively minor financial penalties associated with it – Stephenson wraps up the interview by unpacking the impact of this pharmaceutical malpractice, and the importance of civil law in pushing for genuine change. Sam and Emma also cover Kari Lake and Ruben Gallego’s clash over the exploitations of crisis capitalism, Harris’ complete failure to highlight any of the popular elements of her platform, and the inspiration Donald Trump is finding in the extreme inequality of the Gilded Age. It’s Hump Day! And Sam is live from the Mass Torts Conference in Las Vegas! After touching on the important distinction between mass torts and class action lawsuits, Sam is joined by Attorney Kim Adams with Levin Pappantonio to discuss her ongoing litigation against the Canadian porn company formerly known as MindGeek (now Aylo) for encouraging, facilitating, and helping to disseminate child pornography on their site, unpacking the law (Section 230) that protects platforms from legal liability for third-party content and the tension between that and the active production, curation, boosting, and highlighting of said liable content, not to mention the heightened responsibility for pornography companies to be aware of the content the platform and sponsor. After expanding on the extensive community of impacted parties, be they plaintiffs or potential class members, and exploring the distinction between hosting and publishing, Adams summarizes the case’s state right now. Next, Andy Birchfield from Beasley Allen joins, diving right into the ever-ongoing case against Johnson & Johnson for their manufacturing, sale, and promotion of their Talc-based baby powder formula despite internal awareness of the presence of asbestos and the devastating medical impact it can have on mothers and their children, with a particular focus on J&J knowingly marketing this toxic powder as a feminine hygiene product and the resulting development of ovarian cancer amongst consumers. Next, Birchfield dives deep into J&J’s implementation of the “Texas Two-Step” legal maneuver to avoid responsibility, splitting off all of its liabilities from its assets into a separate company, before immediately moving said company to the asbestos-liability haven of North Carolina, where it would attempt to declare bankruptcy and render any attempts at accountability or compensation null. Walking through the circle of attrition that this has created in the courts, as we enter a third attempt to declare bankruptcy, Andy and Sam wrap up with the future of this case and the role public pressure, congressional legislation, and the questionable morals of J&J leadership all play in hopefully bringing this to a close. Sam and Emma also expand on the developing story about the Trump White House’s obstruction of an FBI investigation into Brett Kavanaugh’s allegations of sexual assault. The crew watches Sean Hannity compares abortion restrictions to the draft before chatting with attorneys Brian Barr of Levin Papantonio and the legendary Ben Crump about their representation of Roger Fortson, a U.S. airman shot to death by police.
